What is the Nice Classification?
- Total classes45
- GoodsClasses 1 to 34
- ServicesClasses 35 to 45
- Applied byCGPDTM
The Nice Classification is maintained under the Nice Agreement and revised periodically. India, as a member, applies the current edition through the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM). When you file a trademark, you register it for specific goods or services within a class, and your protection is limited to those goods and services.
Choosing the correct class is the single most important decision in a trademark application. It defines the scope of your protection, the government fee (charged per class), and whether your filing survives examination. For the full registration process, see trademark registration.
How one brand spans multiple classes
Take a brand as familiar as Apple. The name is protected as a word mark, the bitten-apple logo as a device mark, and each is filed across the classes that match what it actually sells, so no one else can trade on its identity.
Shown for illustration only. All third-party marks belong to their respective owners.
How to choose the right class
List what you actually sell
Write down every product you make or sell and every service you provide. Be specific: "cotton t-shirts" and "online retail of apparel" point to different classes.
Separate goods from services
Goods map to Classes 1 to 34, services to Classes 35 to 45. Many businesses need one of each, for example a product (Class 25) plus its online store (Class 35).
Match each to a class
Use the search or the business-type mapper above to match each product and service to its class. Check the class scope, includes and excludes on the class page.
Decide single or multi-class
If you span categories, file a multi-class application or separate applications. Government fees apply per class, so file only the classes you genuinely use.
Verify before filing
A wrong-class filing is not refundable and leaves gaps in protection. Get a free class check from an IncorpX expert before you submit on the IP India portal.
Rule of thumb
If you both make a product and offer a related service, expect at least two classes. A bakery that sells cakes (Class 30) and runs a cafe (Class 43) needs both. When in doubt, protect the class your brand is best known for first.
Trademark cost per class
| Applicant type | Government fee (per class) | Filing mode |
|---|---|---|
| Individual / Startup / Small enterprise | Rs 4,500 | e-filing (with Udyam or DPIIT proof) |
| Company / LLP / others | Rs 9,000 | e-filing |
| IncorpX professional fee | From Rs 6,999 | Search, class check, drafting & filing |
Fees are per class
The government fee applies for each class you file in, so a two-class application doubles the government fee. Listed amounts are IncorpX professional charges for end-to-end assistance; government and statutory fees are charged separately at actuals.
