Design Registration is the legal process of protecting the visual appearance of an industrial product under the Designs Act, 2000 and Design Rules, 2001. Administered by the Controller of Designs at the Patent Office in Kolkata, under the Controller General of Patents, Designs and Trade Marks (CGPDTM), design registration grants the proprietor exclusive rights to apply the design to articles manufactured by industrial process for an initial period of 10 years, extendable by 5 more years (total 15 years).
Cost: ₹7,999 onwards (professional fee + government fee of ₹1,000 to ₹4,000). Timeline: 6 to 12 months from filing to certificate. Process: 7 steps including novelty search, representations, and Form 1 filing. Validity: 10 years, extendable to 15 years. Law: Designs Act, 2000 & Design Rules, 2001.
Design registration protects the visual appearance of a product - including its shape, configuration, pattern, ornament, or composition of lines and colours - as applied to any article by an industrial process. Unlike patents that protect functional inventions, designs protect aesthetic appeal. The design must be new and original, must appeal to the eye, and must not be dictated solely by the technical function of the article.
India follows the Locarno Classification system with 32 classes for categorising industrial designs. The country is a member of the Paris Convention, allowing applicants to claim priority from earlier filings in convention countries within 6 months. With India's manufacturing and design ecosystem growing rapidly, design registration has become essential for protecting product aesthetics in industries ranging from consumer electronics and automobiles to textiles, jewellery, and packaging.
At IncorpX, our team of experienced IP professionals provides end-to-end intellectual property services including design novelty search, professional representations, Statement of Novelty drafting, Form 1 filing, and Controller examination responses. Professional fees start at just ₹7,999, with government fees charged at actuals.
Under Section 2(d) of the Designs Act, 2000, a "design" means only the features of shape, configuration, pattern, ornament, or composition of lines or colours applied to any article - whether in two-dimensional or three-dimensional or in both forms - by any industrial process or means, which in the finished article appeal to and are judged solely by the eye.
The definition explicitly excludes any mode or principle of construction, or anything which is in substance a mere mechanical device. This means design registration protects the aesthetic/visual aspect of a product, not its functional mechanism. The "eye appeal" test is the fundamental criterion - the design must be visually distinctive and appealing when viewed in the finished article.
For a design to be registrable, it must be new and original. A design is considered "new" if it has not been disclosed to the public anywhere in the world before the filing date (or priority date). "Original" means it must originate from the author and not be a copy of a known design. The combination of novelty, originality, and eye appeal forms the three pillars of design registrability in India.
Key Elements of a Registrable Design:
Shape:
The three-dimensional form or contour of an article - e.g., the shape of a bottle, phone, or furniture piece.
Configuration:
The arrangement or interrelation of parts or elements - e.g., the layout of buttons on a remote control.
Pattern:
A decorative design or motif applied to a surface - e.g., textile prints, wallpaper patterns, tile designs.
Ornament:
Decorative embellishment on an article - e.g., engraving on jewellery, embossing on leather goods.
Composition of Lines or Colours:
Arrangement of visual elements - e.g., colour combinations on packaging, graphic patterns on fabrics.
Did You Know?
India registered over 16,000 designs in recent years, with the highest number of filings in Locarno Classes 06 (Furnishing), 09 (Packaging), and 02 (Articles of Clothing). The Controller of Designs at the Patent Office in Kolkata processes all design applications nationally!
What Can & Cannot Be Registered as a Design?
Understanding what qualifies for design protection is crucial before filing. The Designs Act, 2000 and Section 4 specifically outline the criteria for registrability and the exclusions:
Registrable Designs ✓
Non-Registrable Designs ✗
Shape of articles (bottles, phones, furniture, vehicles)
Purely functional features with no aesthetic appeal
Configuration/arrangement of parts (dashboard layouts, control panels)
Designs that are not new or original (prior published)
Mode or principle of construction (mechanical devices)
Important Note!
Under Section 4 of the Designs Act, 2000, a design that has been disclosed to the public anywhere in the world by publication or by use or in any other way before the filing date (or priority date) is not registrable. Always file your design application before making the product public, launching it commercially, or posting it on social media!
Types of Designs That Can Be Registered:
Industrial designs span a wide range of products and industries. Here are the major categories of designs commonly registered in India, along with their typical Locarno Classification:
Product Design
Physical product shapes - mobile phones, laptops, appliances, tools, kitchenware. Locarno Classes 13, 15, 07. Most commonly filed design category in India.
Textile Design
Fabric patterns, weave designs, print motifs, embroidery patterns, saree borders. Locarno Class 05. India's rich textile heritage makes this a high-volume category.
Packaging Design
Bottle shapes, container forms, box designs, carton layouts, label compositions. Locarno Class 09. Critical for FMCG, cosmetics, and food industries.
GUI & Icon Design
Graphical user interfaces, app icons, screen layouts, digital interface elements. Locarno Class 14-04. Rapidly growing category with tech company filings.
Jewellery Design
Ring patterns, necklace configurations, bracelet shapes, pendant designs, watch faces. Locarno Class 11. High-value designs with significant commercial importance.
Furniture Design
Chair shapes, table configurations, cabinet designs, shelving layouts, lighting fixtures. Locarno Class 06. Covers both residential and commercial furniture.
Automobile Design
Vehicle body shapes, dashboard layouts, wheel designs, grille patterns, headlamp configurations. Locarno Class 12. Filed by all major automakers in India.
Architectural Elements
Door handles, window frames, gate designs, tile patterns, sanitary fittings. Locarno Class 25. Applied to building elements with decorative features.
Locarno Classification Tip
India follows the Locarno Classification with 32 classes. Selecting the correct class is critical - filing under the wrong class can lead to objections or delayed registration. At IncorpX, our IP experts ensure accurate Locarno Classification for your design to maximise protection scope.
Who Can Apply for Design Registration?
The Designs Act, 2000 specifies who is eligible to file a design registration application in India. Here are the categories of eligible applicants:
Author / Creator
The person who actually created or conceived the design. The original designer has the primary right to apply for registration under the Designs Act, 2000.
Employer
If the design was created during the course of employment, the employer is deemed the proprietor and can apply. Employment contract terms govern ownership rights.
Assignee
A person or entity who has acquired design rights from the original author through an assignment deed. Must submit the assignment deed with the application.
Legal Representative
In case of the author's death, the legal heir or representative can file the application on behalf of the deceased author.
Any Person (Section 44)
Under Section 44, any person who has acquired the design by agreement, assignment, or transmission from the original author can apply for registration.
Foreign Applicants
Non-residents can file in India directly or through an Indian agent. Convention applicants can claim priority from earlier filings under the Paris Convention within 6 months.
Step-by-Step Design Registration Process:
The design registration process in India involves 7 key steps. At IncorpX, we handle the complete process on your behalf, from novelty search to certificate procurement:
Step 1: Design Novelty Search
Search the IP India Design Search database and international design databases to verify that your design is new and has not been previously registered or published. This critical step helps assess registrability and avoid objections. Our IP experts conduct comprehensive searches across relevant Locarno classes.
Step 2: Prepare Design Representations
Create professional representations or drawings showing the design from all necessary views - front, back, top, bottom, left side, right side, and perspective view for 3D designs. Representations must be clear, accurate, and on A4 paper with 4 cm margins. For 2D designs (patterns), high-quality reproductions are required. Four identical sets are needed.
Step 3: Draft Statement of Novelty
Prepare the Statement of Novelty that clearly describes the new and original visual features of your design. This statement defines the scope of protection and helps the Controller assess novelty. It should specifically identify the shape, pattern, configuration, or ornamentation that makes your design distinctive.
Step 4: File Application in Form 1
Submit the application in Form 1 through the IP India online portal (ipindiaonline.gov.in). Attach all representations, Statement of Novelty, Power of Attorney (Form 2, if filing through agent), priority document (if claiming Convention priority), and pay the government fee (₹1,000 to ₹4,000 depending on applicant category).
Step 5: Examination by Controller of Designs
The Controller of Designs examines the application for compliance with the Designs Act, 2000 - checking novelty, originality, proper classification, completeness of representations, and whether the design falls within registrable subject matter. If issues are found, objections are communicated to the applicant.
Step 6: Respond to Objections (If Any)
If the Controller raises objections regarding novelty, classification, representations, or Statement of Novelty, respond within the prescribed timeframe with amended documents, arguments, or additional evidence. IncorpX attorneys handle all Controller communications and prepare comprehensive responses.
Step 7: Registration & Certificate Issuance
Once the Controller is satisfied, the design is entered in the Register of Designs and published in the Patent Office Journal. The registration certificate is issued, granting exclusive rights for 10 years from the date of registration. Mark your products with the registered design number for legal protection under Section 22.

At IncorpX, we provide integrated IP strategy to protect all aspects of your innovation.
Benefits of Design Registration:
Design registration provides powerful commercial and legal advantages for product creators and manufacturers:
Exclusive Rights
Prevent competitors from copying, imitating, or applying your registered design to their products for up to 15 years. Legal monopoly over product aesthetics.

FAQs on Design Registration
Protecting your product's visual design is an important business decision. Here are answers to the most searched questions about design registration in India, covering process, fees, validity, and legal requirements under the Designs Act, 2000.
Whether you're a product designer, manufacturer, or startup, these FAQs cover everything you need to know about industrial design protection in India.
Design registration is the legal process of protecting the visual appearance of an industrial product under the Designs Act, 2000 and Design Rules, 2001. It covers features of shape, configuration, pattern, ornament, or composition of lines and colours applied to any article. Registration is granted by the Controller of Designs at the Patent Office in Kolkata, under the Controller General of Patents, Designs and Trade Marks (CGPDTM). Once registered, you get exclusive rights for an initial period of 10 years, extendable by 5 more years (total 15 years).
A design registration under the Designs Act, 2000 protects the visual appearance (aesthetics) of a product - its shape, pattern, ornamentation, or configuration. A patent under the Patents Act, 1970 protects the technical function or invention - how something works. Design protection lasts 15 years; patent protection lasts 20 years. If your product has both a unique look and a novel function, consider filing both.
Under Section 2(d) of the Designs Act, 2000, registrable designs include features of shape, configuration, pattern, ornament, or composition of lines and colours applied to any article by an industrial process. Examples include mobile phone casings, furniture shapes, jewellery patterns, textile prints, GUI icons, packaging designs, automobile body shapes, and decorative household items. The design must be new and original and must appeal to the eye.
The following are not registrable under the Designs Act, 2000: (1) designs that are not new or original, (2) designs that have been disclosed to the public before the filing date, (3) designs that are not distinguishable from known designs, (4) designs comprising scandalous or obscene matter, (5) purely functional features with no aesthetic aspect, (6) designs that are essentially a trademark or property mark, (7) book jackets, calendars, certificates, and similar printed material (Section 4 & Rule 14).
Under the Designs Act, 2000, the following can apply: (1) the author/creator of the design, (2) the employer if the design was created during the course of employment, (3) an assignee who has acquired rights from the author, (4) the legal representative of a deceased author, or (5) any person who has acquired the design under Section 44. Both Indian and foreign applicants can file, with foreign applicants claiming convention priority under the Paris Convention.
The design registration process typically takes 6 to 12 months from filing to certificate issuance. If there are no objections from the Controller, a straightforward application can be registered in as few as 3 to 6 months. The timeline depends on completeness of the application, quality of representations/drawings, response to examination queries, and workload at the Design Office in Kolkata.
The Locarno Classification is an international system established by the Locarno Agreement (1968) for classifying industrial designs into 32 classes and 219 subclasses. India follows this system for design registration. Examples: Class 01 (Foodstuffs), Class 06 (Furnishing), Class 09 (Packaging), Class 12 (Vehicles), Class 14 (Recording equipment), Class 21 (Games and toys), Class 26 (Lighting). Correct classification ensures smooth processing and proper protection scope.
Government fees for design registration in India depend on the applicant category: Natural Person (Individual) - ₹1,000 per design, Small Entity (Startup/MSME) - ₹2,000 per design, Other Applicants (Companies/LLPs) - ₹4,000 per design. E-filing attracts a 10% discount. Additional fees apply for priority claims, restoration, and renewal. At IncorpX, our all-inclusive package starts at ₹7,999 covering professional fees, drafting, and filing.
A registered design in India is initially valid for 10 years from the date of registration. Before the expiry of the initial period, the proprietor can apply for an extension of 5 more years by filing Form 3 and paying the prescribed renewal fee. The maximum total protection period is 15 years. After 15 years, the design enters the public domain. Renewal must be filed before the 10th year expiry; a 6-month grace period is available with surcharge.
A Statement of Novelty is a mandatory document filed with the design application that describes what is new and original about your design. It highlights the specific visual features - shape, pattern, configuration, ornamentation, or colour composition - that distinguish your design from existing designs. The statement helps the Controller assess novelty and defines the scope of your design protection. It should be clear, concise, and specifically identify the novel features.
Yes, Graphical User Interfaces (GUIs) and icons can be registered as designs in India under the Designs Act, 2000. They are classified under Locarno Class 14-04 (Screen displays and icons). You must provide clear visual representations showing the GUI/icon as applied to a screen or digital device. Major tech companies like Apple, Google, Microsoft, and Samsung regularly register GUI designs in India for protection of their user interface elements.
Required documents include: (1) Application in Form 1, (2) Four sets of representations/drawings of the design (front, back, top, bottom, left, right views), (3) Statement of Novelty, (4) Power of Attorney (if filing through an agent), (5) Priority document (if claiming convention priority), (6) Applicant identity proof (PAN/Aadhaar for individuals, COI for companies), (7) Address proof, (8) Assignment deed (if applicant is not the creator).
Design registration (Designs Act, 2000) protects the visual appearance of industrially produced articles for 15 years. Copyright (Copyright Act, 1957) protects original artistic, literary, and musical works for 60 years after the author's death. If a design is applied to more than 50 articles by industrial process, it loses copyright protection and must be registered under the Designs Act. For purely artistic works not applied industrially, copyright is the right route.
Under the Indian Designs Act, 2000, each design requires a separate application. Unlike some countries that allow multiple-design applications, India follows a one-design-per-application rule. However, if you have variations of the same design (up to 50 representations showing different views), they can be included in a single application. Designs for different articles must be filed separately, each in the correct Locarno Classification class.
If someone copies or imitates your registered design, you can take legal action under Section 22 of the Designs Act, 2000. Remedies include: (1) Injunction - court order to stop the infringer, (2) Damages or compensation up to ₹50,000 (or actual damages, whichever is higher) per contract, (3) Account of profits made by the infringer. However, you can only claim damages if the design was properly marked with the registration number on the article. Criminal remedies are not available under the Designs Act.
Design registration in India provides protection only within India. For international protection, you must file separately in each country. India is a member of the Paris Convention, allowing you to claim priority from your Indian filing date when applying abroad within 6 months. India has not yet joined the Hague Agreement for international design registration, so individual country filings are required. Consider filing in key markets like the USA, EU, China, and Japan.
The Controller of Designs is the government authority responsible for examining and registering industrial designs under the Designs Act, 2000. The Controller operates from the Patent Office in Kolkata under the Controller General of Patents, Designs and Trade Marks (CGPDTM). The Controller examines applications for novelty and originality, grants or refuses registration, and maintains the Register of Designs. The Controller also handles cancellation petitions under Section 19.
Yes, any person can file a petition for cancellation of a registered design under Section 19 of the Designs Act, 2000 on the following grounds: (1) the design was previously registered in India, (2) it has been published before the registration date, (3) the design is not new or original, (4) it does not qualify as a "design" under Section 2(d), (5) it is not registrable under Section 4. The petition is filed before the Controller of Designs with prescribed fees and supporting evidence.
While it is not legally mandatory to hire a design agent or attorney, it is strongly recommended. The design registration process involves precise technical drawings/representations, proper Locarno Classification selection, drafting the Statement of Novelty, and responding to Controller objections. Errors in filing can lead to rejection or weak protection. At IncorpX, our experienced IP professionals handle the entire process, including professional representations and filings, starting at ₹7,999.
Design registration protects the visual appearance (shape, pattern, ornamentation) of a product under the Designs Act, 2000, valid for up to 15 years. Trademark registration protects brand identifiers (names, logos, slogans) used in commerce under the Trade Marks Act, 1999, valid for 10 years (renewable indefinitely). A design cannot function as a trademark and vice versa. Many products benefit from both: trademark for the brand name/logo and design for the product's unique appearance.
