A Factory License is issued under the Factories Act, 1948 by the Chief Inspector of Factories specifically for manufacturing premises meeting the worker threshold. A Trade License is issued by the Municipal Corporation for all types of businesses. Most factories need both - a Factory License for regulatory compliance and a Trade License for operating within municipal limits.
Factories involved in hazardous processes (as listed in the First Schedule of the Factories Act), industries covered under the Environment Protection Act, 1986, and those in the Red or Orange category of the Pollution Control Board classification require additional Consent to Establish (CTE) and Consent to Operate (CTO) from the State Pollution Control Board.
A Factory License can be amended for changes such as increase in workers, addition of machinery, change in manufacturing process, or modification of factory premises. However, the license is not directly transferable. In case of change in occupier or ownership, a fresh application with updated details must be filed with the Chief Inspector of Factories.
